Knock! Court Decides Bandung City Government to Legally Own Zoo Land
The Bandung City Government has decided to become the legal owner of the Bandung Zoo land. This is based on the decision of the civil trial at the Bandung District Court with the Chief Judge, Yohanes Purnomo adi, SH., MHum and Member Judge, Riyanto Aloysiusi, SH.MH and Asep Sumirat Danaatmaja SH., MH, Wednesday 2 November 2022.
In the results of the Civil Decision No. 402/Pdt.G/2021/PN.Bdg, Wednesday 2 November 2022, several judges' considerations were recorded, including the evidence submitted by the Bandung City Government and the attached image showing the location of the land purchased by Gemente Bandoeng in the Bandung Zoo area.
Bandung City Government can show proof of purchase of Zoo land (TI-1 a to T I-1m).
In addition, the long history of the Bandung Zoo and the opinion of historian Dr. Leli Yulifar, proved that the land of the Bandung Zoo was previously purchased by the Dutch government, and the association of animal lovers was originally established in 1933 and the Tamansari Margasatwa Foundation since 1957.
Furthermore, the Bandung City Government has used the Zoo's land for the public interest by leasing it to the foundation since 1970. In this case, witness H. Iyan used to measure the Zoo's land since 1970 for the implementation of the lease.
Based on the evidence from the Coblong District Head's certificate, the location claimed by the plaintiff is not recorded in Book C. The plot is located in Dago Atas, not the location of the Zoo.
On the other hand, expert testimony Prof. Nurhasan Ismail said, the buyer in the sale and purchase agreement cannot be considered and acts as the owner because the binding is only an intention or promise to make a sale and purchase transaction at some point in the future.
While the sale and purchase is only valid if the sale and purchase deed is in front of the Land Deed Making Officer (PPAT).
In the decision, the Bandung City Government was declared the owner of the authority to install a sign on the land of the Bandung Zoo.
Furthermore, BPN has the authority to take measurements at the request of the Bandung City Government because the land belongs to the Bandung City Government.
Regarding the decision, the Mayor of Bandung, Yana Mulyana, said he was grateful. The reason is, the decision can be a legal basis for the Bandung City Government. He also ensured that he would respect the legal decision that had been taken by the judge.
"The Bandung City Government is always obedient and obedient to every legal decision. We will follow it in accordance with applicable law," said Yana.**
