DPRD Plenary Meeting, Acting Mayor Delivers Answers to General Factions' Views on Five Draft Regional Regulations

Acting Mayor of Bandung, Bambang Tirtoyuliono, delivered answers to the general views of the factions regarding the five Draft Regional Regulations (Raperda) from the 2023 Phase II Regional Regulation Formation Program (propemperda) at the Bandung City DPRD Building, Friday 27 October 2023.

The five draft regulations are:

1. Draft Regional Regulation on Changes in the Arrangement of Street Vendors.
2. Draft Regional Regulation on Environmental Management and Protection.
3. Draft Regional Regulation on Sports Organisation.
4. Draft Regional Regulation on Supervision and Management of Alcoholic Drinks.
5. Draft Regional Regulation concerning the Revocation of Regional Regulation Number 11 of 2011 concerning Management of Land and Buildings Owned by Regional Governments.

Previously, the Acting Mayor of Bandung, Bambang Tirtoyuliono, delivered the Mayor's explanatory note regarding the five Draft Regional Regulations at the Plenary Session, Wednesday, October 25 2023.

He explained that the basis for considering changes to draft regional regulation number 4 of 2011 concerning the arrangement of street vendors is that the draft regional regulation regulates the arrangement of locations and places of business for street vendors, namely the red, yellow and green zones.

Then, for the draft regional regulation regarding environmental protection and management plans, Bambang explained, this is a follow-up to the provisions of article 10 paragraph 1 of Law number 32 of 2009 concerning environmental protection and management.

"Each regional head, in accordance with his/her authority, prepares an environmental protection and management plan (RPPLH). This is the basis for preparing the long-term development plan or RPJP and the medium-term development plan or RPJM," he said.

Furthermore, regarding the proposed regional regulation on land management and the return of buildings belonging to the regional government, the Bandung City Government is trying to make it happen in Regional Regulation number 21 of 2012, concerning the Implementation of Sports and Levy for Sports Recreation Places.

The organization of sports and fees for sports recreation areas currently need to be evaluated. This can be realized as follows, Regional Regulation number 21 of 2012 and its amendments which combine 2 different legal objects in 1 regulation.

Organizing sports, which is a non-mandatory government matter, is not related to community services, while levies are a support for regional government affairs.

He added, Regional Regulation number 21 of 2012 and its amendments have not been adjusted to the latest sports developments such as e-sports and exhibition goals for 2019 - 2030.

Meanwhile, the draft regional regulation regarding the handling, supervision and control of alcoholic beverages in the city of Bandung has been regulated in Regional Regulation number 11 of 2010. However, in its development it is considered that it has not accommodated changes, especially regarding the consumption and distribution of alcoholic beverages.

"To accommodate this, the Bandung City Government submitted a draft regional regulation regarding the handling, supervision and control of alcoholic beverages, which is an improvement on Regional Regulation number 11 of 2010," he said.

In substance, this draft regional regulation was made in accordance with policies, a sales system that was changed to direct sales, age restrictions, not providing broad promotions, classification and classes of alcoholic drinks, as well as restrictions on the location of sales of alcoholic drinks.

"As for the supervision and control of this draft regional regulation, a special team or team will be formed to assist the Mayor in carrying out this supervision and control," he said.

Apart from that, regarding the basis for consideration regarding the draft regional regulation for the revocation of Regional Regulation number 11 of 2011, concerning Management of Regionally Owned Land and Buildings, Bambang explained that the regional regulation is no longer in accordance with the applicable laws and regulations.

With the stipulation of Government Regulation (PP) number 27 of 2014 concerning Management of State or Regional Property, state-owned land, as amended by Government Regulation (PP) number 28 of 2020, it is necessary to revoke Regional Regulation number 11 of 2011 because it no longer has criteria for delegation of authority.

The explanatory note was followed up with a general view of the factions regarding the five proposed Regional Regulations.

In today's Plenary Meeting, Special Committees 6, 7, 8 and 9 were also formed to discuss the Draft Regional Regulation in question.

Special Committee 6 is tasked with discussing changes to the arrangement of street vendors and the revocation of Regional Regulation Number 11 of 2011 concerning Management of Land and Buildings Owned by Regional Governments.

Special Committee 7 is tasked with discussing the Draft Regional Regulation on Environmental Management and Protection.

Special Committee 8 is tasked with discussing the Draft Regional Regulation on Sports Organisation.

Special Committee 9 is tasked with discussing the Draft Regional Regulation on the Supervision and Management of Alcoholic Drinks. (rob)***
