Bandung City Prosecutor's Office Holds Restorative Justice Counseling

The Bandung City District Attorney's Office (Kejari) carries out legal counseling and information with the theme of a humanist and just law enforcement paradigm with a Restorative Justice approach at the Bandung City Hall Auditorium, Wednesday, 11 October 2023.

This activity was attended by sub-district and village heads in Bandung City. The counseling was opened directly by the Head of the Bandung City Prosecutor's Office, Rachmad Vidianto.

During the counseling, the Head of the General Crimes Section, Muslih, explained that restorative justice is the resolution of criminal cases involving the perpetrator, victim, family of the perpetrator/victim, and other parties.

"The parties are jointly seeking a fair solution by emphasizing restoration of original justice and not retaliation," explained Muslih

A number of restorative justice provisions, namely, if a suspect has committed a crime for the first time, the crime is only threatened with a fine/imprisonment of no more than 5 years. Finally, the criminal act is committed with the value of the evidence/value of the loss caused not exceeding IDR 2,500,000.

On that occasion, the Head of Pre-Prosecution Sub-Section, Cristian Dior, revealed a case of restorative justice.

There was a case of motorbike theft and confiscation in an area in Bandung City. Residents caught the thief and the thief. However, in the end, this problem could be resolved with restorative justice. This is thanks to the role of regional officials, religious leaders and community leaders.

"When we mediate, the first stage is at the police level. From the police level it is delegated to the prosecutor's office. At the prosecutor's office the file will be checked to see whether it is suitable for RJ or not. If it is feasible, we will invite the perpetrator, victim, local environment and religious figures," said Cristian

According to him, in law enforcement there are three elements that must always receive attention, namely justice, benefits or results (doelmatigheid) and legal certainty.
